A incidência do crime de abandono intelectual nos casos de educação domiciliar

Education, instruction, and pedagogy are indispensable mechanisms in the evolution of human potential. Pedagogy can adopt various forms, among which include institutionalized schooling, distance learning, and domestic instruction, colloquially known as homeschooling. In Brazil, this method of education became the focus of a paradigm shifting ruling by the Supreme Federal Court (STF), which affirmed its constitutionality, whilst simultaneously recognizing the illegality of the circumstances under which families that opt for homeschooling find themselves. The contemplation regarding the criminal implications of its practice, particularly in relation to Article 246 of the Penal Code in the absence of a permitting law, is a matter of significant concern for the Public Prosecutor’s Office, all stakeholders in the network safeguarding the rights of children and adolescents, and families who choose to educate their children within the confines of their homes.
