Racist behavior as a cause for the establishment of non-pecuniary damages to a class of individuals: thoughts on the work carried out by the Public Prosecutors’ Office

Abstract

This paper deals with the establishment of non-pecuniary damages to a class of individuals due to racist behavior, especially in cases involving social media which rapidly spreads hatred on the internet, since such kind of behaviors represent a very serious violation of the human rights and demand the work of public prosecutors to ensure the fundamental right to racial equality. Therefore, based on a historical digression and by means of establishing concepts such as structural racism, institutional racism, recreational racism, we intend to build a hermeneutic ground with an anti-discrimination bias, focusing on the analysis of concrete situations of racial discrimination that have been brought to courts, and, especially, the method of intervention carried out by the Public Prosecutors on such legal proceedings, in the sense of a political agent and while seeking reparation for damages to a class of individuals who have been targeted by such behaviors.
