Abstract

The present work analyzes the current context, in Brazil, the possibility of applying the Non-Prosecution Agreement to the crime of narcotics trafficking, in its privileged form, especially with the recent decisions of the courts, including the Superior Court of Justice, which have shown themselves to be more flexible, with regard to the characterization of the offense, thus making it more difficult to convict in a criminal action, therefore preventing a possible crime from having any result for the agent, since the worst thing for society is to see the impunity to the application of the ANPP.
