Abstract

This article aims to analyze the role of the Public Prosecution Service in the custody hearing in promoting the human rights of the detained person, as well as a tool for external control of police activity. The custody hearing arises as a national and international legal framework for protecting human rights in cases of flagrant detention, as well as preventing police abuse and torture. It is a judicial procedure in which the legality of the detention and the need for the detainee to remain in custody are evaluated, in which the Public Prosecution Service plays a fundamental role. Thus, its competences and attributions in the custody hearing will be discussed within the perspective of the function of the prosecutorial body. The effectiveness of its actions will be evaluated, its practice will be valued, and the possible challenges faced will be identified. The study is conducted through a qualitative and quantitative documentary and bibliographic research, using a deductive method. In conclusion, it was found that the role of the Public Prosecution Service in custody hearings is not only essential to ensure effective protection of the human rights of the detainees, but also an important tool in the fight against police abuse and violence. Therefore, investing in this method of external control, with continuous improvement and valorization of the practice, is investing in a fairer and safer future for all.
