Mandatory children and adolescents vaccination: considerations regarding the limits of private autonomy in the face of State impositions

Abstract

This work presents a study on the relation between State and Family in terms of ensuring adequate health conditions to children and youngsters, while analyzing the limits of private autonomy in face of state discretionary power. The paper analyzes the theme of vaccination measures due to the recent Covid-19 pandemic. In this context, in addition
to other matters, the paper analyzes the ruling of Theme 1103 by the Brazilian Federal Supreme Court, which assessed the issue involving mandatory vaccination by the Brazilian government in face of the rights to freedom of personal convictions attributed to parents and guardians of
children. Finally, as a conclusion, the paper brings some considerations about the effectiveness of such thesis and the caution needed on such matters in order not to bring negative effects to those who are being protected – children and youngsters.
