Forgotten victims: the criminalization of child and adolescent exposure to interparental violence

This paper discusses the possibility of applying the criminal type described in article 232 of Law no. 8,069/90 in cases of exposure of children and adolescents to interparental violence. Using the parameters of Law no. 11,340/06, which deals with domestic and/or family violence against women, and due to the severe direct and indirect damages that children and adolescents exposed to such conduct may suffer, the constitutional principle of full protection from the perspective of the law was criminal analyzed. In conclusion, the possibility of applying the crime established in art. 232 of Law no. 8,069/90 when this is examined by the optics of the second degree deceit. From this, it seeks to point out the need for attention to children and adolescents subjected to such violence.
