Medidas para a efetividade do termo de compromisso de ajustamento de conduta relacionado à ordem urbanística

Abstract

This article addresses the role of the Brazilian Public Prosecutor’s Office as a defender of the legal order and social interests and the imperative need to fulfill the obligations entered into under the terms of the consent decree. The work focuses, more specifically, on the adjustments related to urban reorganization and the structuring of public bodies responsible for implementing the public policy for urban land regularization (REURB), establishing obligations for the improvement of the conditions of sustainability of informal urban centers. The challenge of the present work is to present some measures that can guarantee the feasibility of the consent decree, encouraging the voluntary fulfillment of the obligations assumed within the established term and in the indicated manner, as well as addressing possible administrative routes through legal institutes that will expedite the forced compliance with the obligations. The approach gives prestige to the insertion of conditions and guarantees for the faithful fulfillment of the obligations established in the consent decree to guarantee the practical result equivalent to its performance.
